1. Eligibility & adult content
You must be at least 18 years old and legally able to enter this agreement in your jurisdiction. Escapade contains adult-oriented, sexually themed content. By using it you confirm you are 18+, that adult content is legal where you live, and that you consent to viewing it. If any of this is untrue, do not use the service.
2. Your account
Keep your login secure and your information accurate and current. You are responsible for all activity under your account. One account per person, or one shared account per couple. Verification (photo + live selfie) is required; providing false identity information is grounds for removal.
3. Acceptable use
You agree to follow our Community Guidelines. Harassment, non-consensual behavior, impersonation, spam, commercial solicitation, scraping, and any illegal activity are prohibited and may result in immediate removal.
4. Prohibited content (zero tolerance)
You must never upload, share, or request: content depicting anyone under 18 (CSAM); non-consensual or "revenge" intimate imagery (NCII); content of any person who has not consented to it; sexual content involving minors, non-consent, incest, bestiality, or trafficking; or content that is otherwise illegal. We remove such content, terminate accounts, preserve evidence, and report apparent child sexual abuse material to NCMEC and law enforcement as required by law. We provide a fast removal path for non-consensual intimate imagery.
5. Your content & the license you grant
You keep ownership of the photos, video, and text you post. You grant Escapade a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, adapt (e.g. thumbnails), and display your content to other members for the purpose of operating, moderating, securing, and improving the service. This license ends when you delete the content or your account, except for copies retained in backups or as required by law for a reasonable period.
6. Your promises about content (warranty of rights)
For everything you upload, you represent and warrant that: you have all rights necessary to post it; every identifiable person depicted is at least 18 years old and has consented both to the content being created and to it being posted here (including your partner); and the content does not violate any law or third-party right. You agree to keep records of that consent and to provide them to us on request.
7. Records for explicit content (18 U.S.C. §2257)
To the extent Escapade hosts sexually explicit depictions of real people, we maintain the records required by 18 U.S.C. §2257. Direct §2257 inquiries to joinescapade@gmail.com.
8. Copyright & DMCA
If you believe content here infringes your copyright, send a notice with the elements required by 17 U.S.C. §512 to our Designated Agent at joinescapade@gmail.com. We remove infringing content, honor counter-notices, and terminate repeat infringers.
9. Events
Events are organized by members, not by Escapade. You attend entirely at your own risk and are responsible for your own safety, conduct, and compliance with the law. Hosts control their own guest lists. We do not verify, endorse, or supervise events.
10. Reviews
Member reviews are the personal opinions of their authors, not statements by Escapade. Reviews must be honest and must not be false, defamatory, threatening, or used to "out" or identify anyone against their wishes. We may remove reviews that break these rules.
11. Free service & tips
Escapade is free to use. Any optional tip/donation is voluntary and non-refundable and grants no additional rights.
12. Suspension, termination & appeals
We may suspend or remove accounts that break these terms or the Guidelines, sometimes without prior notice where necessary. If your account is suspended you may contact us to ask why and to request review. You can delete your account at any time; see the Privacy Policy for what happens to your data.
13. Disclaimers
The service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that other members are who they claim to be, and we are not responsible for members' conduct online or in person.
14. Limitation of liability
To the maximum extent permitted by law, Escapade and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages, or for interactions between members or events you choose to attend. Where liability cannot be excluded, it is limited to the amount you paid us in the prior 12 months (which for a free account is $0). Some jurisdictions do not allow certain limitations, so parts of this may not apply to you.
15. Indemnification
You agree to indemnify and hold harmless Escapade and its operators from claims, damages, and costs (including reasonable legal fees) arising from your content, your conduct, your attendance at or hosting of events, or your violation of these terms or the law.
16. Disputes & governing law
These terms are governed by applicable law, and any dispute will be handled by a court of competent jurisdiction. We may add a more detailed governing-law and dispute-resolution process in a future update.
17. Changes
We may update these terms. Material changes will be posted here with a new "last updated" date; continued use after changes means you accept them.
